It is your responsibility to inform us of any food allergies or dietary restrictions. While we take reasonable precautions, we cannot guarantee that our food items are free from allergens due to the nature of our kitchen operations and shared cooking environments.
Nothing in these disclaimers shall limit or exclude any liability that cannot be excluded under applicable law, including the Federal Trade Commission Act, state consumer protection laws, or other mandatory statutory rights.
8. Limitation of Liability
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, PIZZA LUCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR OUR SERVICES.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you to the extent prohibited by applicable state law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

- Your fraudulent, negligent, or intentionally wrongful actions or omissions;
- Any misrepresentation made by you in connection with your use of the Site or services.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without our prior written consent.
10. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Pizza Luce's principal place of business is located, without giving effect to any conflict of law principles that would require the application of the laws of any other jurisdiction.
Subject to the dispute resolution provisions below, you agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States, and you hereby consent to personal jurisdiction in such courts and waive any objection to venue in such courts.
Our services are intended for use by persons located within the United States. We make no representation that the Site or services are appropriate or available for use in locations outside the United States. These Terms are subject to applicable United States federal laws, including the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), the Computer Fraud and Abuse Act (18 U.S.C. § 1030), and applicable state consumer protection statutes.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first contact us in good faith and attempt to resolve any dispute informally. Please send a written description of your dispute to [email protected], including your name, contact information, a detailed description of the dispute, and the relief you are seeking. We will attempt to resolve the dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved within this timeframe, either party may proceed to formal dispute resolution.
11.2 Binding Arbitration
EXCEPT AS OTHERWISE PROVIDED HEREIN, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR YOUR USE OF THE SITE OR SERVICES, SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT.
The arbitration shall be conducted in English and the arbitrator shall apply the substantive laws of the applicable United States jurisdiction as set forth in Section 10 above. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
11.3 Class Action Waiver
YOU AND PIZZA LUCE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or other proprietary rights. Additionally, either party may bring claims in small claims court if the dispute qualifies.
12. Third-Party Links and Services
Our Site may contain links to third-party websites, platforms, or services that are not owned or controlled by Pizza Luce. These links are provided for your convenience and informational purposes only. We have no control over and assume no responsibility for the content, privacy policies, practices, or terms of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.
Our Site may also integrate with third-party services such as payment processors, delivery platforms, mapping services, and analytics providers. Your use of such third-party services is subject to their own terms and conditions and privacy policies. Pizza Luce is not responsible for the practices, data handling, or conduct of any third-party service providers.
13. Food Safety, Allergen Information, and Health Disclaimers
We take food safety seriously and comply with all applicable federal, state, and local food safety regulations, including guidelines issued by the U.S. Food and Drug Administration (FDA) and applicable state health departments.
While we make reasonable efforts to provide accurate allergen and nutritional information on our Site and menu, we cannot guarantee that our food items are free from specific allergens, including but not limited to peanuts, tree nuts, dairy, gluten, eggs, soy, fish, and shellfish. Cross-contamination may occur in our kitchen environment. If you have severe food allergies or dietary restrictions, we strongly encourage you to contact us directly before placing an order to discuss your specific requirements.
Pizza Luce shall not be liable for any adverse reactions, health complications, or injuries resulting from the consumption of our food products, except to the extent required by applicable law.
14. Privacy Policy
Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Site and services, you acknowledge that you have read and understood our Privacy Policy.
To the extent applicable, our data practices comply with relevant United States federal and state privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) for California residents, and the Federal Trade Commission Act regarding unfair or deceptive acts and practices.
15. Term and Termination
These Terms will remain in full force and effect while you use the Site or our services. We reserve the right, in our sole discretion, to:
- Terminate or suspend your access to all or any part of the Site and services, with or without notice, for any reason, including if we believe you have violated these Terms;

- Delete your account and any associated data in accordance with our Privacy Policy.
You may terminate your account at any time by contacting us at [email protected]. Upon termination of your account or access, your right to use the Site and services will immediately cease.
The following provisions shall survive termination of these Terms: Section 6 (Intellectual Property Rights), Section 7 (Disclaimers), Section 8 (Limitation of Liability), Section 9 (Indemnification), Section 10 (Governing Law), Section 11 (Dispute Resolution), and any other provisions that by their nature should survive termination.
16. Changes to Terms of Service
We reserve the right to modify, update, or revise these Terms at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you via email to the address associated with your account or by displaying a prominent notice on our Site.
Your continued use of the Site or our services after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must immediately cease using the Site and our services and, if applicable, close your account.
We encourage you to review these Terms periodically to stay informed of any changes. The most current version of these Terms will always be available on our Site at lucespizzas.click.
17. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, void, or unenforceable for any reason, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. If such modification is not possible, the provision in question shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision of these Terms, all of which shall remain in full force and effect.
The failure of Pizza Luce to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision of these Terms shall only be effective if made in writing and signed by an authorized representative of Pizza Luce.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or agreements published by Pizza Luce on the Site, constitute the entire agreement between you and Pizza Luce with respect to your use of the Site and our services. These Terms supersede all prior or contemporaneous negotiations, discussions, agreements, representations, warranties, and understandings between you and Pizza Luce relating to the same subject matter.
No oral statements, representations, or agreements made by any employee, agent, or representative of Pizza Luce shall be binding on Pizza Luce unless expressly set forth in writing and signed by an authorized officer of the Company.
19. Force Majeure
Pizza Luce shall not be liable to you for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, government orders or restrictions, war, terrorism, labor disputes, power outages, internet service disruptions, or supply chain interruptions. In the event of a force majeure event, we will make commercially reasonable efforts to minimize the impact on our services and resume normal operations as soon as practicable.
20. Electronic Communications and Consent
By using our Site or creating an account, you consent to receive electronic communications from Pizza Luce, including but not limited to order confirmations, receipts, updates regarding your account, and promotional materials (where you have opted in to receive such communications).
